Can That Attorney Be Trusted ?
Sounds like a question that should never have to be asked. I mean - if you can't trust your attorney then who can you Trust? But whose interest is he really looking out for anyway? When I hear stories like the following it makes me wonder. Mrs. struggling homeowner seeks the advice of an attorney to get some help in saving her home that is now facing foreclosure. She goes alone because of her husband's present state of health which is a big contributing factor to how they got into this situation. Mrs. Homeowner also needs relief from all of the other creditors calling about the other bills that have also piled up.
Look Before You Leap
When facing mounting debt and stress and the anxiety that comes with it, it's natural to look for the quickest way to get out from under that situation. But even under these difficult circumstances...
It pays to shop around.
Or you may be paying those attorney fees for the next few Years right along with all of the other debtors under your chapter 13 bankruptcy.
You see...
Mrs. Homeowner didn't realize that she probably could have found someone to help her for much less than the Three Thousand Dollars! That this attorney charged. Because Mrs. Homeowner obviously didn't have three thousand dollars, the attorney took three hundred dollars upfront. He then included himself as a creditor in the bankruptcy plan for the balance owed on his fee.
Needless to say Mrs. Homeowner didn't really realize any of this at the time. Now along with all of the other creditors Mrs. Homeowner already owed money to. She now owes one more.
Heaven help her if she winds up like a large percentage of filers and gets her case dismissed...
Then it starts all over again more fee's to pay on top of fee's still owed.
